Agreement

These terms govern your use of Ate-bit, a household food management app for tracking pantry inventory, planning meals, and organizing recipes. By creating an account or using the app, you agree to these terms. If you do not agree, please do not use the app.

Beta Service

Ate-bit is offered as a beta service. Features may change, be added, or be removed, and the service may be unavailable at times. We provide the app on an "as is" and "as available" basis without warranties of any kind. Do not rely on Ate-bit as your only record of important information.

Your Account

You are responsible for the activity on your account and for keeping your sign-in credentials secure. You may sign in with a Google or Microsoft account, or create an account with an email address and password. You must provide accurate information and be old enough to form a binding agreement in your jurisdiction.

You must be at least 13 years old to create an Ate-bit account, or at least 16 where your local law sets a higher age for consenting to online services. Ate-bit is not intended for children below that age and we do not knowingly collect their information. A child may use Ate-bit on a shared screen under an adult's account, since that creates no account and collects no information about the child. If you believe a child has created an account, contact us at the address below and we will delete it and its data.

Acceptable Use

You agree not to:

  • Use the app for any unlawful purpose or in violation of these terms.
  • Attempt to gain unauthorized access to the app, other accounts, or its systems.
  • Interfere with, disrupt, or place undue load on the service or its infrastructure.
  • Upload content you do not have the right to use, or that is unlawful or harmful.
  • Use the AI assistant for anything other than food, cooking, groceries, and meal planning, or try to work around the limits described below.

Your Content

You keep ownership of the data you enter, such as recipes, meal plans, pantry inventory, and product information. You grant us permission to store and process that data solely to operate and provide the app to you and your household, as described in our Privacy Policy.

AI Assistant

Ate-bit includes an AI assistant, called Nibble, provided for food, recipe, pantry, and meal-planning purposes only. Its answers are generated automatically, may be inaccurate or incomplete, and should be checked before you rely on them. It is not a person, and it is not a substitute for your own judgment in the kitchen.

The assistant does not provide medical, dietary, allergen, or food-safety advice, and nothing it says should be treated as such. You are responsible for checking ingredients against any allergies or dietary needs in your household, and for safe food handling, storage, and cooking temperatures.

Shopping Lists and Purchases

Ate-bit builds shopping lists from your recipes, meal plans, and pantry, and lets you copy, print, download, or share them. The amounts on a list are calculated from data in your household's account, some of which may have been entered or suggested automatically, and they can be wrong. Check a list, including the quantity on every line, before you shop from it.

Once a list leaves the app it is outside our control. If you give one to a shop, a delivery service, an AI assistant, or any other tool that can place orders for you, you are responsible for reviewing what is ordered and what it costs before it is bought. Ate-bit does not place orders, take payment, or act as a party to any purchase you make.

Availability and Changes

We may modify, suspend, or discontinue the app, in whole or in part, at any time. We may also update these terms. If we make material changes, we will update the "last updated" date above and, where appropriate, notify users within the app.

Termination

You may stop using Ate-bit and delete your account at any time from Settings. We may suspend or end your access if you violate these terms or use the app in a way that could cause harm to the service or other users. Account and data deletion follow the retention periods described in our Privacy Policy.

Limitation of Liability

To the fullest extent permitted by law, Ate-bit and its operators are not liable for any indirect, incidental, or consequential damages, for any loss of data, or for the cost of anything ordered or bought from a list the app produced, arising from your use of or inability to use the app.

To the fullest extent permitted by law, our total aggregate liability to you for all claims arising out of or relating to these terms or your use of the app will not exceed the greater of the amounts you have paid us for the app in the 12 months before the claim arose, or US$100.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded or limited. Some places do not allow certain warranties to be disclaimed or certain damages to be limited, so parts of this section may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless Ate-bit and its operators against any third-party claim, demand, loss, or expense, including reasonable legal fees, arising out of content you add to the app, your use of the app, or your breach of these terms.

This applies only so far as the claim arises from something you did or failed to do. It does not cover a claim caused by our own acts or omissions, and it is not aimed at ordinary use of the app for your own household. If we ask you to cover a claim, we will tell you promptly and you may take over defending it with a lawyer of your choosing.

Governing Law

These terms, and any dispute arising out of them or out of your use of the app, are governed by the laws of the State of Arizona, United States, without regard to its conflict of laws rules. You and we agree that the state and federal courts located in Maricopa County, Arizona have jurisdiction over any such dispute, and each of us consents to venue in those courts.

If you live outside the United States, this does not take away the protection of any mandatory consumer law of the country you live in, and it does not stop you bringing a claim in your local courts where that law gives you the right to do so.
